Disclaimer of Warranty
Purchasers recognize and understand that parts and materials manufactured and/or sold by Our Hugs for Designs by Danielle are exposed to many and varied conditions due to the various manufacturing practices of its suppliers and the general uniqueness of handmade items. Purchasers and Designs by Danielle consciously desire to make their own bargain, irrespective of any court decision and purchasers agree upon good faith and in consideration for being allowed to purchase from Designs by Danielle said parts or services. Purchasers expressly acknowledge and understand that Designs by Danielle does not make any affirmation of fact to promise to purchaser, which relates to said parts, inventory, or services that becomes part of the basis of the bargain between Designs by Danielle and purchasers, nor does Designs by Danielle make, or cause to be made to purchaser any description of the goods sold to purchaser.
As further consideration for purchasers using Our Hugs for Designs by Danielle products and services, any and all inventory and services, purchasers acknowledge that due to the differing conditions and circumstances under which all products are manufactured and received from vendors, purchasers expressly affirm they are relying upon their own skill or judgement to select and purchase suitable goods.
Our Hugs for Designs by Danielle makes no warranties whatsoever, expressed or implied, oral or written, to purchasers. There is no warranty of merchantability made to purchasers. Designs by Danielle further excludes any implied warranty of fitness with respect to imaginative and pretend play, any and all inventory and service.
It is expressly understood and agreed between purchasers and Designs by Danielle that as part of the bargain between Designs by Danielle and purchasers, and in consideration of doing business with each other, all purchasers take, select and purchase said child toys, baby products, or services from Our Hugs for Designs by Danielle "as is" and "with all uniquely handmade qualities". If and in the event that purchasers expressly or implied cause representations, or statements or affirmations of fact contrary to this disclaimer of all warranties, expressed or implied, then purchasers agree to indemnify and hold harmless Designs by Danielle in the event of any claim, demand, or legal action against Designs by Danielle by any purchaser.
Purchasers understand and agree that no officer or salesman of Designs by Danielle has any authority to make any statement contrary to the terms of this agreement. On the contrary, Designs by Danielle disavows any statement contrary to what is herein above written.
So, in plain English to you and me: I, Danielle Jenkins, owner of Designs by Danielle and administrator of the Our Hugs website, will make any and all possible efforts to ensure your satisfaction and enjoyment of all products sold or advertised. I encourage feedback and will refund your purchase from my store, excluding all affiliates (see respective website warranties for any affiliate issues), within 180 days if you, for any reason, are unhappy with our products. But you, as the purchaser, have to promise to be reasonable in your requests! ;)
